Terms and Conditions

This ticket is sold by Western District Health Service (WDHS), a not for profit community organisation responsible for the organisation of this Event. The following conditions of sale apply (including any resale or subsequent assignment), entry and attendance at the Event.

‘You’ and ‘your’ refers to the customer. ‘We’, ‘us’, ‘our’, ‘WDHS’ and ‘Event organiser’ refers to Western District Health Service, its employees, contractors, volunteers and authorised persons.

In accordance with Victorian Government directions, all persons attending the Beats in the Bot Music event either during the main event, set-up or pack-up in Feb 2022 will be required to be fully vaccinated, or possess a certified medical exemption. Ticket holders, artists, volunteers and contractors will need to provide proof of full vaccination upon entry to the event.

Ticketing

  1. Tickets are sold subject to WDHS and online sales platform, conditions of sale and the terms and conditions of entry of the Event venue – Hamilton Botanic Gardens.
  2. All ticket sales are final. Once purchased, tickets are the sole responsibility of the purchaser. Tickets are not transferable under any circumstance. It is a condition of sale that tickets may not be offered for commercial re-sale and they are only valid if purchased from through WDHS.
  3. In the event that we are forced to cancel due to COVID-19 restrictions, you will be assured a 90% refund of the ticket purchase price, minus booking fee. 10% of your ticket purchase price will be retained to ensure contractors and artists are paid a retainer, if not their full contracted rate.
  4. If you are unable to attend the event due to contracting COVID-19, or COVID-19 related symptoms, or you are required to self-isolate or quarantine, or due to COVD-related state or international border closures, please contact WDHS to arrange a refund. Medical or other evidence will need to be provided to WDHS to claim a refund. Please note, 90% of your ticket price will be refunded, as in point 3 above.
  5. No refunds or exchanges will be available unless the Event is cancelled, or is rescheduled and you do not wish to attend the alternative date, or for COVID-19 related reasons as detailed in point 4.
  6. A COVID-Safe plan will be in place in accordance with Government requirements. All attendees must comply with the relevant regulations at the time of the event.
  7. You must supply the correct full name and contact details of all attendees at the time of purchase.
  8. Ticket orders will be cancelled if credit card funds are unavailable.
  9. Companion Card holders who purchase a ticket will be provided with a complimentary ticket for their companion/carer. To arrange the complimentary ticket, please contact community.liaison@wdhs.net (a copy of the Companion Card must be provided).
  10. If entering the Event as an adult, ID to prove legal age must be shown if requested. Children under the age of 18 will not be allowed to enter the Event with an adult ticket.
  11. CHILD TICKETS: For duty of care reasons, and in keeping with the family-based nature of the Event, child tickets can only be purchased in conjunction with an adult ticket or by an adult who has already purchased a ticket. There is a limit of 6 child tickets for each adult ticket.. WDHS reserves the right to refuse sale of child tickets if there is reason to suspect that the accompanying responsible adult policy is being exploited. A child is aged between 13 and 17 years of age on the day of the Event. Children must be accompanied by the responsible adult.
  12. A responsible adult is a person who is either a parent or acting in place of a parent and who could reasonably be expected to exercise responsible supervision of the child. Proof of age for child tickets may be required, such as driver learner permit or school ID. WDHS also reserves the right to refuse entry to those who present as a youth for wrist banding at the Event and fails to satisfy WDHS personnel they are accompanied by the responsible adult who purchased the ticket. It is recommended that the phone number of the responsible adult should written on the child’s wristband to assist with location should the child become lost.
  13. The online TICKET is required to be shown at Entry or tickets can be purchased at the gate.
  14. If you lose your ticket, please email community.liaison@wdhs.net to have your tickets re-sent.
  15. Artists and Venues WDHS reserves the right to add, withdraw or substitute artists, vary any advertised program, change venue and vary audience capacity. No claim for compensation shall be made in the event that the program is varied due to the non-appearance of an advertised artist.
  16. Chairs and picnic rugs may be brought into the Event, unless where otherwise signed, but must be kept in their designated area. We may direct you to move or remove chairs from the Event for any reason.
  17. Audio & Visual All ticket holders consent to any official filming, photographic and sound recording as members of the audience. All ticket holders consent to the reproduction of the photographs/video from the event in which they appear in any WDHS publications, displays or paid advertising related to the promotion of the health service, also in any publication (including internet, social media, newspapers and magazines) produced by other agencies to which WDHS might supply the photographs for general purpose of the promotion of the health service.
  18. No equipment, recording device, phone or camera will be allowed where the user is intending to use the photos, audio or video for unauthorised commercial use. Any person not in possession of an official WDHS Media Pass endorsed for film and/or photography as appropriate, found using a video camera or any device to record performances may be expelled from the venue, lose their wristband, and may render the offender liable for legal action.
  19. Liability WDHS disclaims any and all liability for the acts, omissions and conduct of any third party including the products, services, actions or failure to act of any venue or other person in connection with the performance or referred to on this site.
  20. Entry is at the ticket holder’s own risk. WDHS shall not be held liable for any loss, injury or damages sustained entering or on the site – to the extent allowed by the law. The right to refuse entry is reserved by WDHS and venue providers.
  21. WDHS takes no responsibility for any hearing damage or loss, please use ear plugs if necessary.
  22. You will be liable for any loss or damage caused at the Event by you or your invitees.
  23. As a ticket holder I, for myself, my heirs, my executors and administrations herby waive and release the event organisers, its agents, affiliates, employees, members, sponsors, promotors, volunteers and any person or body directly or indirectly associated with the event from all claims, demands and proceedings arising out of or connected with my participation in this event and indemnify them against all liability for all injury, loss or damage arising out of my participation in this event.
  24. This agreement of the terms and conditions continues forever and binds my heirs, successors, executors, personal representatives and assigns. I hereby acknowledge that I have sole responsibility for my personal possessions and equipment during the event.
  25. Smoking, alcohol, illegal drugs and glass – Smoking and alcohol consumption will be in accordance with the Hamilton Botanic Gardens terms and conditions
  26. This event is a BYO event, WDHS will have the right to evict patrons who disobey or break Responsible Service of Alcohol legislation and the law.
  27. Ticket holders agree to comply with all WDHS security arrangements, as well as those of the venue provider, including personal searches (if deemed necessary by WDHS). All ILLEGAL DRUGS, WEAPONS, or DANGEROUS ITEMS are prohibited and will be confiscated. No claim may be made against WDHS or the venue provider for items confiscated. Persons found in possession of illegal drugs, weapons or dangerous items will be removed from the venue, will lose their ticket and may face criminal charges.
  28. WDHS or the venue provider may refuse admission to any ticket holder for any reasonable cause and may request any ticket holder to leave the venue for any reasonable cause.
  29. You agree to a search of your person or possessions on entry to the Event.
  30. Privacy – The information requested is only used in the processing of your tickets; in accordance with the Privacy Act 1988, the information is not supplied to any third party.
  31. Tickets cannot be used as part of any marketing, media or sales promotion whether commercial or non-commercial without prior written consent of the Event organisers.
  32. General safety – In the case of an emergency evacuation or situation, you must follow all WDHS and other directives of official personnel.
  33. No animals will be permitted onto the Event site, with the exception of assistance dogs.
  34. Fires and fireworks are not permitted.
  35. Activities such as moshing, crowd surfing and stage-diving are not permitted. Patrons engaging in these or other dangerous activities will be evicted from the Event and will lose their ticket
  36. All minors will be the responsibility of the parent or guardian and must be supervised at all times.
  37. Environment and community – WDHS cares for the environment and community. Please recycle wherever possible and place all waste in the appropriate bins provided.
  38. Please respect our town and neighbours. Do not create excessive noise and do not litter while traveling to and from the Event.
  39. General – Any breach of any of these terms and conditions will entitle the Event organisers to evict the ticket holder from the venue and confiscate any ticket without refund.

By purchasing tickets for this event you accept the terms and conditions for yourself and on behalf of all nominated people you purchase tickets for.
